Alabama Child Relocation Notice & Objection Rules

The Alabama Parent-Child Relationship Protection Act establishes procedures that may apply when a parent changes a child’s principal residence, or primary home, for 45 days or longer. Whether these procedures apply can depend on the custody order, the move’s distance and destination, statutory exceptions, and any enforceable agreement between the parents.

The statutory procedures generally apply when the new residence would be more than 60 miles from the non-relocating parent or outside Alabama. A parent planning a covered move generally must provide written notice with specific information at least 45 days before relocating when reasonably possible. Different requirements may apply if the parent couldn’t have known the necessary information in time.

A parent with custody or visitation rights may object and request temporary or permanent relief. The objection generally must be filed within 30 days of receiving notice. Defective notice, good cause, excusable neglect, military duties, domestic violence, and other circumstances may affect this deadline. Because a missed objection period can limit the available options, prompt legal review matters.

What Alabama Courts Consider in Relocation Cases

A court won’t decide the case solely on the moving parent’s reason for leaving or the distance involved. Alabama law identifies numerous factors concerning the child, both parents, and the proposed parenting arrangement.

Depending on the evidence and requested relief, relevant considerations may include:

  • The child’s relationships: Connections with each parent, siblings, extended family members, schools, and other significant people or institutions.
  • Development and stability: The child’s age, educational needs, emotional development, special needs, routine, and likely adjustment to the move.
  • Continuing contact: Whether a revised parenting plan can preserve a meaningful relationship with the non-relocating parent.
  • Travel demands: Transportation time, expense, exchange arrangements, and the feasibility of exercising visitation.
  • The parents’ reasons: Their reasons for seeking or opposing relocation and their conduct surrounding the proposed move.
  • Safety and support: Available support systems and any history of domestic violence or child abuse.

If the court permits the move, it may also address electronic communication, transportation and travel costs, revised visitation, child support adjustments, and supervision of the transition. The issues before the court will depend on the existing order, the relief requested, and the evidence presented.
